Mandatory Employment Disclosures - MED Request

Assembly Bill (“AB”) 2534, which became effective January 1, 2025, amended Education Code section 44939.5 to require local educational agencies (LEAs) to inquire of each LEA that previously employed an applicant for certificated educational employment whether the applicant, “while previously employed,” was the subject of any credible complaints of, substantiated investigations into, or discipline for egregious misconduct that were required to be reported to the California Commission on Teacher Credentialing, and to provide all relevant documentation in its possession upon request.  Subsequently, Senate Bill (“SB”) 848, signed into law on October 7, 2025, and effective January 1, 2026, expanded these requirements and added to Education Code section 44051 a similar process for non-certificated applicants. Under section 44051, persons applying for non-certificated positions must provide a complete list of all prior educational employers, and former employers must disclose any credible complaints of, substantiated investigations into, or discipline for egregious misconduct that were within the scope of the statute and provide all relevant information in their possession when responding to the inquiry.
